The WHITERAZRXMAS Scavenger Hunt (“Promotion”) starts at 12:00 PM PST and ends at 6:00 PM PST on December 20, 2011. (“Promotion Period”). ELIGIBILITY: Promotion open only to legal residents of the United States, 18 years of age or older who reside within sixty (60) miles of the Los Angeles metropolitan area. The first individual to identify and arrive at the location of a hidden White DROID RAZR phone will be deemed a potential winner. Promoter’s determination of the first individual to identify and arrive at each location of a hidden phone will be final. GRAND PRIZES (3): A White DROID RAZR by Motorola. Approximate Retail Value (“ARV”): $649.99 each. All prize details are at the sole discretion of the Promoter. Mobile phone service not included. All prizes are awarded “as is” with no warranty or guarantee, either express or implied. No substitution, transfer, or cash equivalent of prize is permitted, except by Promoter, which reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. Any and all federal, state and local taxes on the prizes, and any other costs, fees, and expenses not explicitly stated herein as being awarded, including but not limited to mobile phone service, are the sole responsibility of the winners. CLAIMING PRIZE: Unclaimed prizes will not be awarded. As a condition of winning the prize, winners must complete, sign and return an affidavit or eligibility and liability and publicity release, where permitted by law, and any other applicable forms required by a taxing authority. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Promoter his/her prize. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. By accepting prize, entrants consent to Promoter’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. Upon delivery to the winner, Promoter will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize. FOOTAGE: Individuals arriving at the locations of the hidden phones may be photographed, videotaped and otherwise recorded by Promoter (collectively, "Footage"). Footage will be owned by Promoter who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes. By accepting a prize, Grand Prize winners agree that his/her name and likeness and those of any other individuals present at the applicable hidden phone location may be included in the Footage, in Promoter’s sole discretion. Grand Prize winners agree to help Promoter retain necessary releases (as applicable) if requested by Promoter to do so. Should any portion of the Promotion be, in Promoter’s sole opinion, compromised by non-authorized human intervention or other causes, which, in the sole opinion of the Promoter, corrupt or impair the administration, security, or fairness of the Promotion or submission of information, Promoter reserves the right at its sole discretion to terminate the Promotion.
